In the context of the "Justice and Home Affairs" Council held in Luxembourg on 14 April 2005 under the chairmanship of the Luxembourg Minister for Justice, Luc Frieden, the Member States signed the convention on the accession of Cyprus, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland, Slovakia and Slovenia to the 1980 convention on the law applicable to contractual obligations.
By virtue of their accession to the European Union, the 10 new Member States have committed themselves to adhering to the convention on the law applicable to contractual obligations, opened for signature in Rome on 19 June 1980, as well as to the first and second protocols regarding its interpretation by the Court of Justice of the European Communities.
The Rome Convention establishes uniform rules concerning the law applicable to contractual obligations of an extraneous nature. The convention is open for signature to States who are party to the Treaty establishing the European Community. It is currently in force among the 15 "old" Member States. The instrument is regarded as part of the acquis communautaire.
The Commission plans soon to transform the international convention into a Community regulation. The instrument will thus be modernised.
